TERMS AND CONDITIONS OF SALE
PREAMBLE
We are pleased to welcome you to our website, www.hindkroussa.com (hereinafter referred to as the “Website”).
These Terms and Conditions of Sale exclusively govern the sale of products offered on the Website.
By placing an order, the Customer fully and unconditionally accepts these Terms and Conditions.
Any conflicting terms stipulated by the Customer shall therefore not be binding on LA MAISON HIND KROUSSA PARIS, 1 rue Treilhard, 75008 Paris, unless expressly accepted, regardless of when such terms may have been brought to its attention.
Hind Kroussa SASU makes every effort to ensure that the information published on the Website is accurate and up to date, and reserves the right to correct its content at any time without prior notice.
Any matter not covered by these Terms and Conditions shall be governed by the practices and French laws in force relating to distance selling.
1. PURPOSE
These Terms and Conditions govern the sale of products by Hind Kroussa SASU, a French single-member simplified joint-stock company with a share capital of €20,000, registered with the Paris Trade and Companies Register, with SIRET number 882 310 691 00010, whose registered office is located at 1 rue Treilhard, 75008 Paris, France (hereinafter referred to as “Hind Kroussa”), exclusively to adult individuals acting as private consumers and not in a business capacity (hereinafter referred to as the “Customer”).
2. PRODUCTS
2.1 Product characteristics
The products available for purchase online are those displayed on the Website. Hind Kroussa describes and depicts them on the Website as accurately as possible.
The information provided on each product page includes, in particular, the product’s essential characteristics, such as colour, description, composition, care instructions and dimensions, together with its price inclusive of all taxes.
However, Hind Kroussa draws the Customer’s attention to the fact that photographs cannot guarantee an exact match with the product offered for sale, particularly with regard to colours.
Hind Kroussa shall not be held liable for any obvious error or minor omission in the depiction and/or description of a product’s characteristics.
The product offers and prices displayed on the Website remain valid for as long as they appear on the Website, subject to stock availability.
2.2 Product availability
Products are offered for sale subject to stock availability. Only products displayed on the Website at the time the Customer visits it are available for purchase.
When placing an order, the Customer is informed of the availability of the selected Product.
If a product is unavailable, Hind Kroussa undertakes to inform the Customer by email as soon as possible and, where applicable, to provide an estimated delivery timeframe.
The Customer may confirm their order or request a refund for the product based on the invoiced price.
3. PRICES
Prices are stated in euros (€), inclusive of all taxes, including VAT, but excluding handling and delivery charges, which vary depending on the destination country. The prices displayed include the VAT rate applicable on the date the order is placed.
The fixed contribution towards handling and delivery costs is communicated to the Customer in the order summary before the order is confirmed.
Placing an order constitutes acceptance of the prices and descriptions of the products available for sale.
Orders placed at incorrect or manifestly unreasonably low prices will be cancelled, even if they have already been approved by Hind Kroussa. Hind Kroussa will inform each affected Customer as soon as possible so that they may, if they wish, place their order again at the correct price.
4. ORDERS
Customers must complete the required fields to create their customer profile and obtain their personal login credentials.
To place an order, the Customer must complete a registration form and provide the information necessary to identify them, including:

A valid email address.

The personal information marked with an asterisk, which is mandatory and required for invoicing and order delivery.
4.1 Placing an order
Customers wishing to place an Order must select the Product or Products of their choice by clicking “Add to cart”.
After completing this step and clicking “Finish shopping”, an order summary page will appear on the screen. The Customer can then make any changes before confirming by clicking “Proceed to payment”.
4.2 Confirming an order
When placing an order, the Customer confirms to Hind Kroussa that they are authorised to use the payment method selected for their purchase.
By confirming their shopping cart and order summary and accepting these Terms and Conditions of Sale, the Customer agrees to proceed to the payment stage to confirm the order.
The amount payable by the Customer is the amount shown in the order summary, which the Customer reviews before confirming their order. This confirmation constitutes express acceptance of all transactions carried out on the Website.
The order is processed only once the Customer has entered their bank card number, expiry date and security code, which is the three-digit number on the back of the card. Payment is subject to final authorisation by the GIE Cartes Bancaires bank card organisation.
In all cases, entering the bank card number online and providing final confirmation of the order shall constitute proof of the entire order in accordance with the provisions of the French Act of 13 March 2000, and shall render payable the amounts corresponding to the items listed in the order.
This confirmation constitutes a signature and express acceptance of all transactions carried out on the Website.
However, in the event of fraudulent use of a bank card, the Customer is asked to contact Hind Kroussa customer service as soon as they become aware of such use.
4.3 Payment security
Hind Kroussa uses the secure payment services PayPal and Stripe, which incorporate SSL security standards.
Confidential information, including card numbers and expiry dates, is encrypted and transmitted directly to the payment provider’s server. It is never transmitted to our server.
4.4 Order acknowledgement
The Order becomes final once payment has been authorised.
An email confirming the Order and payment will be sent to the Customer to acknowledge that the order has been recorded.
5. DELIVERY
Except in cases of force majeure or unforeseeable and unavoidable circumstances, the delivery timeframes shall be those indicated below and shall run from the date of order confirmation. These timeframes are communicated to the Customer before the order is confirmed and payment is made.
Hind Kroussa takes every precaution to ensure that parcels arrive in perfect condition. Nevertheless, the Customer must check the condition of the packaging and ensure that the delivered product conforms to the order, noting any issues on the carrier’s delivery slip where applicable.
5.1 Delivery methods
Parcels may be delivered by La Poste to the Customer’s home address or to another address of their choice, as specified in the delivery form.
Hind Kroussa processes parcels from Monday to Friday. Orders are generally processed within 7 to 10 business days. Additional transit times depend on our delivery partners.
Home delivery by La Poste
If the Customer is absent, a delivery notice will be left in their letterbox. The parcel will be held for 15 days at the post office nearest to the delivery address.
5.2 Delivery areas
Delivery is available in France and in the areas specified at checkout.
5.3 Delivery timeframes
All deliveries are made within a maximum of 7 days of the order date.
If delivery is more than 7 days overdue, except in cases of force majeure, the Customer may, within 60 days of the original delivery deadline:

Report the delay by email to contact@hindkroussa.com. Hind Kroussa will then contact the postal services to initiate an investigation, which will take no more than 30 days. If the parcel has not been located by the end of the investigation, the Customer will receive a refund for their order.

Alternatively, cancel the order and request a refund by sending Hind Kroussa a registered letter with acknowledgement of receipt.
6. RIGHT OF WITHDRAWAL
6.1 Exercising the right of withdrawal
In accordance with the law, the Customer has a period of 15 (fifteen) days from receipt of their order to exercise their right of withdrawal, without having to provide a reason or incur any costs other than those necessary to return the order.
To exercise this right, the Customer must return the order form provided in the parcel, attached to their order confirmation email or available on the Website, or submit any other unambiguous statement expressing their decision to withdraw.
Products must not have been worn or washed and must be returned in their original packaging, with their original labels, together with the invoice or delivery note. The invoice is available on the Website under “My Account”, and the delivery note is included in the parcel.
Please note: items returned incomplete, broken, damaged or soiled by the Customer will not be accepted.

6.2 Available return methods
The Customer must return the ordered products within 15 (fifteen) days of communicating their decision to withdraw, under the conditions set out in Article 6.1 above.
Return shipping costs remain the Customer’s responsibility.
Returns by post
The Customer may return the ordered items to Hind Kroussa at their own expense, together with their withdrawal form or another unambiguous statement of withdrawal and their invoice, to the following address:

Returns may only be sent by post to the address indicated above.
7. EXCHANGES AND REFUNDS
Hind Kroussa allows Customers to change their minds within 15 days, provided that they present the order form, for any item that is unworn, in its original packaging and from the current season.
The item must be accompanied by its original label and invoice.
Please note: items returned incomplete, broken, damaged or soiled by the Customer will not be accepted.
Postage costs are the Customer’s responsibility, unless the return results from an error by Hind Kroussa.
The refund is issued upon receipt of the parcel. The Customer’s bank account will be credited directly with the amount paid for the returned items through our secure payment partner.
8. COMPLAINTS
For any questions about an order, Hind Kroussa customer service is available through the “Contact us” section.
In the event of a dispute, the Customer must provide their order number and the precise reason for their enquiry.
9. PERSONAL DATA
Hind Kroussa informs Customers that, when they place an order on the Website, the personal data recorded about them will be used by its internal departments, those of its sister companies and/or companies within the group to which Hind Kroussa belongs:

To inform them of news and upcoming events by sending newsletters.

To offer them promotional offers and competitions.
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, as amended, Customers have the right to access and correct their personal data at any time.

10. WARRANTIES
The products offered comply with the French legislation in force.
All Products benefit from the statutory guarantee of conformity provided for in Articles L211-4 et seq. of the French Consumer Code, as well as the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
11. LIABILITY
Despite the care taken in preparing our Website, the photographs and text depicting and describing the products may occasionally contain errors.
If a Customer receives an item that does not conform to the one displayed on the Hind Kroussa Website, they may request an exchange and/or refund in accordance with Article 8 of these Terms and Conditions of Sale.
Hind Kroussa shall not be held liable for failure to perform the contract in the event of:

Stock shortages or product unavailability.

Disruption or a full or partial strike, particularly affecting postal services or transport.

Floods, fires, any event of force majeure, or any other unforeseeable event or circumstance beyond Hind Kroussa’s control.
12. APPLICABLE LAW AND DISPUTES
This contract is governed by French law.
The language of this contract is French.
In the event of a dispute, the French courts shall have exclusive jurisdiction.
13. CHANGES TO THE TERMS AND CONDITIONS OF SALE
In view of possible changes to the Website, Hind Kroussa reserves the right to adapt or amend these Terms and Conditions of Sale at any time.
Where applicable, the updated Terms and Conditions of Sale will be brought to the Customer’s attention through their publication online and will apply only to sales made after the amendment.
