Terms of sale

Preamble

These General Terms and Conditions of Sale govern sales of products offered on hindkroussa.com (the “Website”) by LA MAISON HIND KROUSSA PARIS, a French SASU with share capital of €20,000, registered with the Paris Trade and Companies Register, SIRET 100 638 410 00017, whose registered office is at 1 rue Treilhard, 75008 Paris, France (“Hind Kroussa”). Contact: contact@hindkroussa.com · +33 1 84 60 45 23.

They apply to adult individuals acting for non-business purposes (the “Customer”). Placing an order entails full acceptance of these terms. The version in force on the order date applies.

1. Products

The products offered are those displayed on the Website, subject to the availability and production conditions stated on each product page. Their essential characteristics (colour, description, composition, care and dimensions) appear on each page. Photographs are as faithful as possible, but slight colour differences may occur depending on the screen.

Some creations are made to order, semi-bespoke or bespoke. When a creation is out of stock but remains available to buy, orders can still be placed: production may take up to three weeks, in addition to preparation and transit times. The applicable lead time is stated before the Customer confirms the order.

If a product becomes unavailable after ordering, Hind Kroussa informs the Customer promptly by email. The Customer may wait for restocking or receive a refund within 14 days.

2. Prices

Prices are in euros, inclusive of all taxes, excluding delivery charges. Delivery charges are shown before order confirmation and detailed in the shipping policy. If the Customer selects another currency, conversion is indicative; the reference price remains the euro price. An order placed at a manifestly incorrect, derisory price may be cancelled; the Customer will be informed and refunded.

3. Orders

The Customer selects products, adds them to the cart, checks the order summary and total price, then confirms by paying. The order becomes firm once payment is approved. An email summarising the order is then sent to the Customer.

4. Payment

Payment is made online by bank card, Apple Pay or PayPal through secure payment services. Banking data is encrypted and sent directly to the payment provider; Hind Kroussa never stores it.

5. Delivery

Orders are prepared within 7 to 10 working days after payment approval. Made-to-order creations, including those ordered when stock is depleted, require additional production time of up to three weeks, disclosed before ordering. Transit times, destinations and charges are detailed in the shipping policy.

The Customer is invited to inspect the parcel on receipt and report any issue to contact@hindkroussa.com, with photographs. Risk of loss or damage transfers to the Customer when they take physical possession of the products.

If delivery exceeds the stated date or period, the Customer may, after requiring Hind Kroussa to deliver within a reasonable additional period, cancel the contract in writing if delivery still does not occur, in accordance with Article L216-6 of the French Consumer Code. A refund is then made within 14 days.

6. Right of withdrawal

The Customer has 15 calendar days from the day after receipt of the last item in the order to exercise the right of withdrawal without giving a reason. This is more favourable than the statutory minimum of 14 days. If the final day is a Saturday, Sunday or public holiday, the deadline extends to the next working day.

To exercise this right, the Customer sends an unambiguous statement by email to contact@hindkroussa.com or by post to LA MAISON HIND KROUSSA PARIS, 1 rue Treilhard, 75008 Paris, France. The form below may be used but is not mandatory.

The Customer must send back the products at their own expense no later than 14 days after notifying their decision, to LA MAISON HIND KROUSSA PARIS, Service retours, 1 rue Treilhard, 75008 Paris, France. Products may be tried on as in a shop. They should be protected for return, with accessories and, if possible, their original labels and packaging. The Customer may be liable for diminished value resulting from handling beyond what is necessary to establish the products’ nature, characteristics and functioning; this does not automatically remove the right of withdrawal.

Hind Kroussa refunds all sums paid, including standard delivery charges, within 14 days of being informed of withdrawal, using the original payment method. The refund may be withheld until the products are received or evidence of dispatch is provided, whichever occurs first.

Under Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • goods made to the Customer’s specifications or clearly personalised, including bespoke or semi-bespoke goods;
  • sealed goods that cannot be returned for health protection or hygiene reasons and have been unsealed after delivery, where the legal conditions for this exception are met;
  • digital content (e-books) supplied immediately with the Customer’s express consent and waiver of the right of withdrawal.

Products made to the Customer’s specifications or clearly personalised cannot be returned, exchanged or refunded for a change of mind. Choosing a standard size or colour, production after ordering or lack of stock does not, by itself, constitute personalisation. Statutory guarantees remain applicable to all products, including personalised products, in the event of defects or non-conformity.

Optional withdrawal form: “To LA MAISON HIND KROUSSA PARIS, 1 rue Treilhard, 75008 Paris, France, contact@hindkroussa.com. I hereby notify you of my withdrawal from the contract for the following goods: [item], ordered on [date] / received on [date], order number [number], Customer’s name and address, date and signature (for a paper submission).”

7. Exchanges

The Customer may request one exchange of a non-personalised item eligible for return for another size or colour within 15 days of receipt, subject to stock availability. Details appear in the returns and refunds policy.

8. Statutory guarantees

All products benefit from the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

The Customer has two years from delivery to invoke the statutory guarantee of conformity if a lack of conformity arises. During this period, they need only establish the existence of the defect, not when it arose. They may obtain repair or replacement or, failing that, a price reduction or cancellation of the contract. Under the guarantee against hidden defects, they may also choose between cancellation of the sale and a price reduction.

Hind Kroussa pays return costs for non-conforming products or an error on its part.

9. Customer service and complaints

For questions or complaints: contact@hindkroussa.com, +33 1 84 60 45 23, or LA MAISON HIND KROUSSA PARIS, 1 rue Treilhard, 75008 Paris, France. Please include your order number and the reason for your request.

10. Personal data

Data collected when ordering is used to process the order, manage customer relations and, with the Customer’s consent, send news and offers. The Customer has rights of access, rectification, erasure, restriction, objection and portability, exercisable at contact@hindkroussa.com. See the privacy policy for details.

11. Force majeure

Hind Kroussa cannot be held liable for failure to perform its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code.

12. Applicable law and disputes

These terms are governed by French law and are drawn up in French. In the event of a dispute, the Customer should first contact customer service to seek an amicable solution. Failing that, the dispute may be referred to the competent courts as provided by law.

13. Changes to these terms

Hind Kroussa may amend these terms at any time. The version in force on the order date applies.
